Supreme court rules working hours can base on company regulations

South Korea's Supreme Court says an employee's working hours on public holidays can be determined based on the Labor Standards Act... as well as a company's own regulations... ruling in favor of the employees.
The top court overturned the judgement of an appeal sending back a case filed by a group of 20 sanitary workers in Cheorwon, Gangwondo Province, to the Seoul High Court.
The workers demanded their company pay them the extra amount of earnings, including public holidays, ... that were excluded from their ordinary wages.
The sticking point was whether to calculate the working hours on paid public holidays into four hours according to the company regulation or eight hours suggested by the Labor Standards Act.
A worker's ordinary wages are calculated based on an hourly wage system, and so less working hours means higher pay per hour.
