Judge kills high school Christmas nativity scene for 'endorsement of religion'

ELKHART, INDIANA — A U.S. judge has ruled that a high school's live depiction of the nativity scene in their annual Christmas show is unconstitutional because it endorses religion.

Last week Judge Jon DeGuilio banned Concord High School from using the nativity scene in a school show, the Elkhart Truth reported. The nativity scene shows presents the birth of Jesus.

An unnamed son and father — with the help from the Freedom From Religion Foundation and American Civil Liberty Union — filed a lawsuit against the school because they felt the depiction was overly religious. Judge DeGuilio agreed, saying the scene was unconstitutional because it endorsed religion.

The school tried to play ball by including depictions of Chanukah, Kwanzaa, and other celebrations, but because these were only briefly shown on screens, while Christianity got a live scene, Judge De Guilo noted the school placed a disproportionate emphasis on Christendom.

The school has since removed the live nativity scene from their Christmas show as a pre-trial date for the case has been set for January 7.

Concord High School has previously included a live depiction of the nativity in their annual Christmas show for decades, reported the Elkhart Truth.
