Gjykata Kushtetuese ka vendosur heqjen e kombësisë nga ligji për gjendjen civile. Te enjten gjyqtaret i kane gjetur nenet 58 dhe 42 te këtij ligji qe parashikojnë deklarimin e kombësisë dhe ndërrimin e saj me vendim gjykate ne kundërshtim me kushtetutën.
Ky vendim i marre 6 me 2 nga trupa kushtetuese, erdhi pas kërkesës se kryetarit te gjykatës se Sarandës, Alltun Çela, ne një periudhe kur ndërrimi i kombësisë me vendim gjykate, u be një fenomen shqetësues veçanërisht ne jug te vendit. Pas këtij vendimi ka reaguar edhe Aleanca Kuqezi e cila e ka cilësuar vendimin e dyte historik pas rrëzimit te marrëveshjes për ndarjen e ujerave territoriale me Greqinë. Si pasoje e këtij ligji rreth 4000 persona kane ndryshuar kombësinë gjate 2 viteve te fundit,kryesisht ne jug te vendit. Rrëzimi i neneve te ligjit për gjendjen civile ne te gjitha rastet nuk prek regjistrimin mbi baze etnie dhe feje, pasi censusi qe fillon ne 1 tetor parashikohet nga një tjetër ligj dhe behet për efekt statistikor.
The Constitutional Court has decided the removal of nationality by law on civil status. On Thursday judges have found the articles 58 and 42 of this law to provide a declaration of nationality and its replacement by a court to be unconstitutional.
This decision taken by 6 with 2 troops constitutional requirement that the President came after the Court of Saranda, Alltun Cela, in a period when the change of nationality by the court, became a particularly worrying phenomenon in the south of the country. After this decision has reacted Kuqezi Alliance which has set a second decision after the crash of historic sharing agreement with Greece's territorial waters. As a result of this law around 4000 people have changed nationality during the last 2 years, mainly in the south of the country. Collapse of the Articles of the Law on civil status in all cases does not affect the registration on the basis of ethnicity and religion, as the census which begins Oct. 1 provided by another law and done for statistical purposes.
