Why PH can't sue builders of 2nd class bunkhouses

MANILA - Rehabilitation czar Panfilo Lacson on Monday criticized construction firms that deliberately built substandard bunkhouses in areas hit by super typhoon "Yolanda", saying they should not be allowed to repair the structures. In a press briefing, Lacson said the government cannot outright file cases against these construction firms since the procurement law allows the repair of the structures in a specific time period. "We are hampered by [Republic Act] 9184, na may 60-90 days allowed to contractors to repair. We should amend that because if deliberate yung underspecs bakit pagbibigyan mo pa na i-repair? Yun yung ginagamit nilang scapegoat, na hindi mo kami pwedeng kasuhan dahil may 60-90 days pa kami i-repair yung di namin ginawang tama," he said. He said he will propose to Congress to amend that particular provision in the procurement law. Lacson earlier said he received information of possible anomalies and kickbacks involving at least one politician colluding with contractors who were building the bunkhouses for Yolanda victims. He said that while the bunkhouses were not overpriced, some appeared to have been built using substandard materials. "There is no question, there is no overpricing. There were civil engineers who looked at the standard specs of [Public Works and Highways Secretary] Secretary Babes Singson and we agreed [there was] underspecs and substandard materials and substituting of materials," he said. The rehabilitation czar said one effect of the overpricing issue is that personalities being linked to the anomalies are now lying low and are no longer meddling with the construction. "Yesterday, we found out na nag lie low na yung mga nakikialam sa bunkhouses dahil nga dun sa napag-usapan...Aware sila, alam nilang babantayan natin at di lulusot. Hindi rin sila babayaran, according to Secretary Babes. Hindi nila babayaran yung may diperensya," he added. Lacson said coordination of local politics is still the biggest challenge in the rehabilitation of areas affected by super typhoon Yolanda. He said said his work is purely coordination of the post-Yolanda rehabilitation, with the full support of government line agencies. "Ang mga challenges is mostly sa local. Local politics alam naman natin dun mababaw yung pulitika dun. Kapag kalabang mayor, hinid -inapansin yung bayan. The other day I told them during the meeting with the LGUs kung gusto niyong parusahan yung kalabang mayor nadadamay kasi yung mga constituents na hindi naman nila kalaban. They were really receptive when I talked to them and they shared with us yung mag problema dun sa mga areas," he said.
