Independence Day: man told to remove American flag on his balcony by condo management - TomoNews

GREELEY, COLORADO — In anticipation of Independence Day, a resident of an apartment complex decided to hang an American flag on his balcony. When management of his apartment complex asked him to remove the flag as it was in violation of the community code, he instead decided to read management’s letter out loud in a video he then published to YouTube and Facebook.

LETTER FROM STERLING HEIGHTS

“Dear Samuel, please be advised that it has come to management’s attention that you have an American flag on the balcony/patio area. Your signed Community Policies states, ‘The use of balconies and patios for the purpose of storage and/or laundry drying is prohibited. Breezeways are not to be used as a patio or storage. Please do not clutter with personal belongings. Balconies and patios must be maintained in a neat, clean and attractive condition. Outdoor and/or patio furniture is welcomed on your patio or balcony only.”

The video immediately went viral and garnered local and national media attention. Many fellow patriots must have voiced their own outrage over this incident, because two days after releasing the video, Samuel Adams began writing pleas on Facebook for the Internet to stop threatening the staff at this apartment complex.

Shortly after the media circus began, Samuel Adams posted that a flag had suddenly appeared by the door of the management office. Not long after that, management notified him that it was okay to hang his flag after all.

According to the Freedom to Display the American Flag Act enacted in 2005, “A condominium association, cooperative or residential real estate management association may not adopt or enforce any policy, or enter into any agreement, that would restrict or prevent a member of the association from displaying the flag of the United States.”
