Judge Napolitano on the Possible Charges George Zimmerman Could Face

As ed earlier, Florida special prosecutor Angela Corey will announce her charges against George Zimmerman in the shooting death of 17-year-old Trayvon Martin tonight at 6p ET.

Earlier on Studio B, Judge Andrew Napolitano discussed the possible charges that could be announced on neighborhood watchman George Zimmerman. There cannot be a murder one charge because you would need a grand jury, which leaves murder two and manslaughter as possible charges.

Essentially Judge Napolitano said the government needs to prove a different state of mind, therefore, it makes all the difference in the world regarding what they actually charge him with because, he says, that most prosecutors regularly overcharge to give the jury a maximum opportunity to compromise on some form of guilt.

When it comes to the ethical obligations, Judge Napolitano said, "They are not supposed to charge for a crime, which they believe they cannot prove beyond a reasonable doubt."
