Herbert Jones, a 62-year-old man working as a shopping mall Santa in Hanover, Massachusetts has been charged with indecent assault and battery for allegedly groping a female elf.

It was the month before Christmas and, children were getting their photo taken with the fat man at Hanover Mall.

An eighteen-year-old female elf assistant was near Jones's chair when she says he pinched her arse after making an inappropriate comment.

The elf complained that Jones copped a feel after commenting "I wish you were a few years older and I was younger.

Police confronted Jones in Santa's changing room but he pleaded his innocence and in a later interview he said that the girl's butt may have brushed past his hand, but that it was all an accident.

In the Hanover police department report Jones claims that he "only stated that he wished he was young again so he could make different life choices and meant nothing else by it.
