Eric Garner choke death: No indictment for NYPD cop Daniel Pantaleo

Hundreds held protests in major New York City landmarks, in response to a grand jury’s decision to not indict police officer Daniel Pantaleo in the in the chokehold death of Eric Garner.

After four months of deliberations,the Staten Island grand jury, made up of 14 white and nine non-white members, found that there was no "reasonable cause" to indict Pantaleo.

Police suspected Garner, 43, of selling loose cigarettes on July 17 in front of a beauty shop in Staten Island after he broke up a fight between three men. He denied any wrongdoing, as two plainclothes police approached him.

The unarmed father of six died when officer Daniel Pantaleo, 29, attempted to arrest him. Pantaleo applied a rear choke hold and failed to release it even after Garner repeatedly gasped: “I can’t breathe.”The NYPD has banned officers from using chokehold since 1993.

The NYPD Medical Examiner determined that Garner’s death was a homicide by chokehold, saying, “the compression of his chest and prone positioning during physical restraint by police” was responsible. He said other health issues including asthma and heart disease also contributed to Garner’s death.

In his testimony, Pantaleo told the jury that he did not intend to choke Mr. Garner, and that the maneuver was a wrestling technique. He never thought that Garner was in any mortal danger.

The decision came a week after a grand jury declined not to indict Darren Wilson, a white police officer who shot Michael Brown, an unarmed teenager.

Protesters staged a “die-in” at Grand Central before taking the protest to Times Square and the Rockefeller Center as the annual tree lighting took place Wednesday night.

Attorney General Eric Holder announced Wednesday night that a federal civil rights investigation would be opened.
