Judge Rules That Weight Discrimination on the Job Is OK

The Borgata Hotel Casino and Spa in Atlantic City recently prevailed in a lawsuit brought against them for discriminating against their employees based on sex and weight.
Superior Court Judge Nelson Johnson in Atlantic County, New Jersey ruled in favor of the casino when 22 cocktail waitresses, known as the Borgata Babes sued the hotel and casino for gender and weight discrimination.

They were weighed at the start of their employment, and were not allowed a more than 7 percent increase in weight.

As those terms were agreed to by the women before they were hired including a signed agreement, the judge found in favor of the Borgata.

The judge stood by the decision in a statement saying: “For the individual labeled a babe to become a sex object requires that person’s participation and nothing before the Court supports a finding of fraud, duress or coercion in connection with the Plaintiffs’ hiring.”

Michigan is the only state with laws in place that protect employees from being discriminated against based on their weight.

A few cities like Santa Cruz, California, Madison, Wisconsin, and Binghamton, New York also have weight discrimination laws.
