00:00The Industrial Court has thrown out a claim for unfair dismissal brought by a former branch
00:07manager against a government-linked company after he was sacked for sexually harassing
00:12two of his subordinates four years ago.
00:15Court Chairman Eswari Mari concurred with the findings of a disciplinary inquiry conducted
00:20by Amanah Ihtiar Malaysia into nine sexual harassment acts committed in the first six
00:25months of 2019.
00:28The claimant was found to have misconducted himself by attempting to play footsie with
00:32his victims and by touching their cheeks, brushing their hair, placing his hands on
00:37their buttocks, rubbing their shoulders, stalking them and intentionally blocking their path.
00:43Eswari said the company had given the claimant a chance to atone for his actions after the
00:48first act of misconduct by issuing him a stern warning and transferring him to a different
00:53branch, but he did not repent.
00:55Eswari said that as a branch manager, the claimant should have ensured a safe environment
01:00for his subordinates, but he made the working environment toxic through his obnoxious and
01:05intolerable behavior, she added.
01:08She said the company had taken into consideration the claimant's 26-year service, but at the
01:13same time, was obliged to take into account his grave and continual misconduct and the
01:18welfare of other employees.
