01:15 In reaction, Smith's team contends that the former president does not enjoy absolute immunity
01:19 and the actions Trump took to retain power after losing to Joe Biden does not qualify
01:24 as official presidential acts.
01:26 While both U.S. District Judge Tanya Chetkin and a federal appeals panel in Washington
01:31 sided with Smith, the case has been in limbo pending the ongoing appeal process, delaying
01:36 the trial that was initially set for March 4.
01:40 Trump's lawyer also requested the justices to send back the case to Chetkin for additional
01:45 fact-finding if they reject the immunity arguments, which will further prolong the trial proceeding.
