Smith and the DOJ have expressed concerns that Trump's "daily extrajudicial statements" about ongoing cases could threaten to prejudice potential jury pools. Judge Chutkan has previously warned Trump against making "inflammatory" posts that could taint jurors, but he has continued doing so. On Tuesday, Trump shared a New York Post article about Judge Chutkan and posted calling Smith "deranged" with "unchecked and insane aggression." The DOJ cited Trump's ongoing comments in a recent filing, arguing they could "grind litigation in this case to a halt." Smith's team agreed more time is needed to avoid prejudicing jurors.
