The Federal Court today struck down a provision of Selangor Syariah law that criminalises "unnatural sex". The nine-judge panel unanimously declared Section 28 of Selangor’s Shariah Criminal Offences Enactment as void for being unconstitutional -- as it found that based on the Federal Constitution, the power to make such criminal laws falls under the Parliament, and not the state legislature. The man who brought a legal challenge was among 11 men arrested on suspicion of attempting "sexual intercourse against the order of nature" during a raid at a private residence.
