In the judgment of the bench of Justice Arun Mishra, it is clearly stated that this is an interpretation of the amendment in the Succession Act 2005. In fact, in the year 2005, this law was made that both son and daughter will have equal rights in their father's property.

पिता की संपत्ति को लेकर सुप्रीम कोर्ट ने बड़ा फैसला सुनाया है. सुप्रीम कोर्ट ने बड़ा फैसला सुनाते हुए कहा है कि बेटियों का पैतृक संपत्ति पर बराबर का अधिकार होगा. जस्टिस अरुण मिश्रा की बेंच के फैसले में साफ कहा गया है कि ये उत्तराधिकार कानून 2005 में संशोधन की व्याख्या है. दरअसल साल 2005 में ये कानून बना था कि बेटा और बेटी दोनों को अपने पिता के संपत्ति में समान अधिकार होगा.
