Why should Gogoi’s emergence as a Rajya Sabha MP matter? Because as chief justice and master of the roster he presided over – or allocated to benches that he chose – several important cases in which the Modi government was a party. And the same government’s eagerness to give him a six year term as an MP suggests a disconcerting cosiness between judge and litigant – a most powerful litigant at that.
