If SC is convinced then why's government not fighting for Martyrs in International Court of Justice?

Can India forget the mutilated remains of Capt. Saurabh Kalia or can we forget the beheading of our brave Jawan Lance Maik Hemraj. With the centre dilly dallying on dragging Pakistan to the International Court of Justice on the Saurabh Kalia case and other brutalities by Pak on Indian prisoners of war, Supreme Court has taken a tough stand on the issue and questioned the centre. In what comes as a rap to the government, the apex court observed that if river disputes are taken to international court of justice, why can't the issue of prisoners of wars be taken up in ICJ. The centre in its reply maintained that the case can't be taken to ICJ as Pakistan has not agreed for it. Remember Prime Minister Modi in the run up to the Lok Sabha polls has slammed the Foreign Policy of the then UPA government.
