Ruto, Sang Allowed Appeal [News Bulletin]

The ICC Trial Chamber has allowed Deputy President William Ruto and Journalist Joshua arap Sang to appeal a decision that allowed ICC Prosecutor Fatou Bensouda to use statements of recanting witnesses.

The judges say admitting recanted evidence will affect the outcome of the trial.

They further say application of the amended rule 68 will interfere with the fair and expeditious conduct of the proceedings.

Ruto's and Sang's defence teams had requested for leave to appeal the decision in which Bensouda wants prior recorded statements of five witnesses who recanted to be admitted as evidence.

The lawyers said the amendment was passed at the 12th session of the Assembly of State Parties and that they were assured it would not apply on active cases.
