A family in Massachusetts has filed a lawsuit against Panera Bread in a peanut allergy case.
The Boston Globe is reporting that, on January 28, Elissa Russo submitted an online order for her family from the chain’s location in Natick.
She claims to have noted in the system twice that the grilled cheese was intended for a child who is allergic to peanuts.
However, when the 5-year-old girl bit into the cheese sandwich later that day, her parents noticed that it contained peanut butter, notes WFXT.
According to Boston.com, her subsequent vomiting led to a hospital visit, and a breakout of hives resulted in an epinephrine shot and overnight stay.
When her father called to complain to the restaurant manager on the night of the emergency, he is said to have received an apology and an explanation that the incident was likely due to a language-related mix-up.
Although Panera warns that allergen-free foods cannot be guaranteed because of common equipment and handling, the family is suing because, according to their attorney, “This isn’t a cross contamination case.”
