Teacher who sexted boy kept arm over nipples and left panties on — not technically ‘nudity’

SIDNEY, OHIO — Anna High School substitute teacher Mary Breth, 25, looks set to escape any serious consequences after it was revealed she’d been carrying on an “inappropriate” text-message relationship with an underage student. The student was of course not named, but local newspaper Sidney Daily News reports that he was just 14-years-old when the teacher began sending him “flirtatious” text messages in 2013.
As the years progressed, the messages reportedly became more sexual in nature, and culminated in a photo taken sometime in November 2015 showing Breth wearing only underwear and covering her breasts with her arms.
The same local paper reports that on Jan. 6 and Jan. 7, the Shelby County Sheriff’s office received two separate tip-offs claiming Breth was sending nude photos to an underage student.
A subsequent investigation uncovered the pair’s “inappropriate” relationship dating back to 2013, but as both parties had deleted all incriminating evidence aside from the single photo, prosecutors only had the photograph and their confessions as evidence.
Because the teacher did not actually display any “erogenous zones,” she did not cross the legal line into nudity and therefore was only charged with contributing to the delinquency or unruliness of a child. She will soon appear in Shelby County Probate Court Juvenile Division to answer that charge.
Authorities say unless additional evidence comes forward, no further charges will be filed against Breth. Ohio’s board of state teachers, however, will soon determine if Mary Breth should lose her teaching license.
