Japan’s Top Court: Spouses Must Have The Same Surname

The highest court in Japan has ruled in favor of upholding the law requiring married couples to have the same surname.

The legal battle over spouses in Japan having to change their surnames after marriage has ended.
The country’s highest court has ruled to keep a 19th century law which mandates that couples share the same last name after becoming spouses.
The plaintiffs in the case were three separate women and a couple who fought to overturn the requirement based on the grounds that it was unconstitutional and discriminated against women.
While either person’s name could be adopted under the law, the man’s family name is taken about 95 percent of the time.&nbs
