Bystander with concealed carry shoots at Home Depot shoplifters

AUBURN HILLS, MICHIGAN ? A woman trying to stop shoplifters opened fire in a Home Depot parking lot around 2 p.m. on Tuesday afternoon in Auburn Hills.

The Detroit Free Press reported that the two suspects managed to get away with more than $1,000 in stolen merchandise. One of the suspects, described as a white male in his 40s or 50s, was caught on camera as a loss prevention worker was trying to stop him as he left the store. He is seen running to the getaway vehicle, a black SUV driven by the second suspect, described as a black male in his 40s.

According to The Oakland Press, as the pair were driving away, a bystander in her late 40s pulled out her licensed 9mm pistol and opened fire on the vehicle an undisclosed number of times, possibly hitting the vehicle's back tire. The suspects got away, and Auburn Hills Police are hunting for them.

The shooter stuck around after the incident and cooperated with police. She has a concealed carry license, but due to the circumstances in which she decided to use her gun, she could face legal repercussions, such as a potential felony firearm charge, reckless use of a firearm, or felonious assault charges, the Detroit Free Press reported. According to WXYZ, there were several people in the area when she fired her weapon.

Michigan law, however, does in some circumstances protect people who use deadly force stop a felony, with state courts upholding the "fleeing-felon rule."
