12-yr-old black kid's suspension for staring at white girl upheld by court

GLENDALE, OHIO-- An Ohio court actually upheld the suspension of a 12-year-old black boy for staring at a white girl at school in what the boy described as a "staring contest."
The student was suspended from private Catholic school St. Gabriel Consolidated near Cincinnati in September of last year after school authorities say he "intimidated" his classmate.
According to the boy, he and the white girl were having staring contest and that the girl was giggling the entire time.
However court documents state that the girl said she "felt fearful," so the school decided to suspend the boy even though he wrote an apology saying he meant no harm.
"I never knew she was scared because she was laughing," he wrote. "I understand I done the wrong thing that will never happen again. I will start to think before I do so I am not in this situation."
His parents filed suit to have the suspension removed.
According to the boy's mother, the same girl was involved in another incident at school that led to no repercussions. "The same girl that accused my son of this act of perception of intimidation, aggressively poured milk on someone else's lunch. When she did that there was no penalties for that. She received nothing for that," the mother said.
According to the school, "the principal is the final recourse in all disciplinary matters and may waive any and all rules at his/her discretion for just cause."
The boy's family intends to file an appeal. When asked if the family felt it was race-related they said, "they were not ready to pull out the race card."
