Texas high school teacher has sex with 16-year-old student

Nikki Scherwitz, a 25-year-old English teacher at Brazosport High School, Houston, avoided going to jail after pleading guilty to charges of sexual assault of a child and improper relationship with a student. She was sentenced to 10 years probation and a $5,000 fine.

According to the police report, the teacher's relationship with the 16-year-old minor had been going on for weeks, and only came to light last April when Scherwitz showed up at an after-prom party at a student's house. She was seen dressed in a "cut up, cut off shirt" and no shoes. She allegedly left with the student after another student told her it was inappropriate for her to be there, and asked her to leave. She is believed to have been drinking.

Many were shocked to learn that Scherwitz was spared jail time as the conviction would have been much harsher if it was a male teacher. Prosecutors explained they had settled with the plea deal as the student was almost 17 and Scherwitz agreed to apologize to the student's mother and the district.

In the letter, Scherwitz wrote, "I apologized for the behavior I engaged in with a student of BISD. It was wrong. I crossed an ethical boundary I never should have crossed".

Scherwitz resigned from her post last year after authorities questioned her about her relationship with the student, and is not allowed to teach again.
